SCALER REFER AND EARN T&Cs

This Referral policy will apply to all users (referred to as 'user', 'users', 'your' or 'you') who are participating in Scaler’s Referral Program offered by InterviewBit Software Services Private Limited (“Scaler”).

By participating in this Referral Policy, User acknowledges, accepts, and agrees to be bound by all of the terms and conditions of this referral policy ('Policy'), which are in addition to and subject to Scaler’s 'Terms of Use' and 'Privacy Policy' available on the Platform. Scaler offers curated and specially designed online higher education, certification programs and career assistance services ('Program'). By accepting this Referral Policy, User consents, agrees and undertakes to abide and be bound to the terms of this Referral Policy.

If you do not agree to this Policy, please do not participate in the Program. Scaler reserves the right to modify or terminate the Program, in whole or in part, at any time and in any manner that Scaler sees fit.

1 Definitions:

a. 'Referrer' or 'you' means a person of 18 years or above, who has completed or is participating in any Scaler Program, and who is referring a Referee, provided that if such person is employed or engaged by Scaler for any work, s/he will not be considered a Referrer under this policy.
b. 'Referee' means the individual who is a friend, relative or connection, of the Referrer, being referred by a Referrer.
c. 'Referral Code' is the code generated by the referrer on the Scaler Platform.
d. 'Referral Policy' means the Scaler Refer and Earn T&C’s.
e. 'Referral Reward' means the benefit available under this program, in the form of cash, vouchers, goodies, scaler coins, or fee waivers as the case may be, for a Qualified Referral.
f. 'Cohort' or 'Batch' defines the month in which the referee/friend has commenced their learning program
g. 'Enrolled Referral': Once a person registers on the Platform as a Learner and purchases a subscription to a Program using your Referral Code, such person shall be considered as your “Enrolled Referral”, subject to the terms herein.
h. 'Program' means the Scaler Academy Program, Scaler Data Science and Machine Learning Program in India or USA, or the Dev Ops Program.
i. 'Platform' means scaler.com, other platform (including chat groups, Scaler hosted social media forums/pages and webpages) which may allow you to access and/or use the services offered by Scaler (for working professionals) via any other device/medium.
j. 'Qualified Referral' means a person treated as an Enrolled Referral, and whose reachable mobile phone number is validly shared (with the Referee’s consent) by the Referrer, that uses the Referral Code of a Referee (in accordance with our Terms and conditions).
k. 'SET' means the Scaler entrance test required to be written for the purpose of batch allocation and admission in the Program.

2 Criteria:

The Referrer must submit a referral by the referral code allotted to them by Scaler (“Referral Code”) by submitting the Referee’s details on the Scaler Platform in Refer & Earn page, in accordance with this policy, for the purpose of referral to a Program.
The referral submission must be completed by the Referrer through the designated referral flow on the Scaler Platform (including the “Refer & Earn” or “Invite Friends” section). Referees are not permitted to apply or enter a Referral Code themselves.
The timestamp at which the Referrer successfully submits the Referee’s details on the Platform shall be considered as the official timestamp of the referral.
Sharing a referral code with a counsellor or any Scaler sales representative shall not be considered a valid referral, and no Scaler employee is authorised to create, apply, or modify a referral on behalf of either the Referrer or the Referee.
The referral shall be considered valid only if the Referee enrols and makes a payment of fees to Scaler within 30 days from the date recorded as the referral timestamp (referral / coupon code validity period). For the avoidance of doubt, a Referral Code cannot be applied, added, or modified after enrolment at any stage.
A person shall be deemed to be “enrolled” if they pay down payment, or full payment towards a Program.

3 System Validation & Error Handling:

All referrals are subject to real-time system validations at the time of submission. If a Referee is ineligible for referral, the Referrer will be shown an error on the Platform, and the referral submission will not be completed.
A referral submission may fail if the Referee: Has had recent engagement with Scaler within the past 30 days.

In such cases, the referral will not be recorded, and no referral benefits shall be applicable. Scaler shall not be responsible for referrals that fail due to system validations or eligibility checks

4 Determination and Payment of Rewards:

A. For the Programs:
The reward receivables for referrals shall be determined based on the cohort in which the Referee has registered, completed payment formalities, and successfully enrolled in a Scaler Program.
Referral rewards shall be applicable only for Qualified Referrals, and only after the Referee:
  • Successfully enrolls in a Scaler Program, and
  • Completes the applicable trial / refund period without opting for a refund.

The referral shall be considered valid only if the Referee enrolls and makes a payment of fees to Scaler within 30 days from the referral submission timestamp (referral / coupon code validity period). Referrals where the Referee does not enroll within this validity window shall be treated as unsuccessful, and no referral rewards or discounts shall be applicable. The Referee’s reward, for an Enrolled Referral, shall be in the form of a fee waiver on the Program fees, of such amount as may be determined by Scaler from time to time, and shall be applied at the balance payment stage. The Referee’s reward is subject to change for every cohort, at Scaler’s sole discretion.

Referral rewards shall be payable only for Qualified Referrals and shall be subject to applicable taxes, including but not limited to Tax Deducted at Source (TDS). Referral rewards shall be credited directly to the Referrer’s registered bank account, as per the details shared on the Platform.

Eligible referral rewards shall be processed within 45 - 60 days after the referred learner completes the applicable trial / refund period, provided all eligibility and compliance requirements are met.

As per Section 206AB of the Income Tax Act, 1961 (inserted by the Finance Act, 2021), if a Referrer qualifies as a “specified person” under Section 206AB, tax shall be deducted at source on referral rewards at the higher of:
(a) 5%, or
(b) twice the rate applicable to referral fees.

For the purposes of this clause, a “specified person” means a person who has not filed income tax returns for both of the two assessment years relevant to the two previous years immediately preceding the financial year in which tax is required to be deducted, and for whom the aggregate of tax deducted at source and tax collected at source is INR 50,000 or more in each of those two previous years.

Scaler may verify the Referrer’s status as a “specified person” using the facilities made available by the Income Tax Department and deduct applicable taxes accordingly.

Scaler will track Enrolled Referrals generated by the Referrer through the referral submission process and will make this information available to the Referrer via the dashboard on the Platform and/or through official communications (including email or WhatsApp). Referral benefits shall be applicable only where the referral submission is successfully recorded on the Platform prior to the Referee’s enrollment.

Any failure on the part of the Referrer to submit correct or complete referral details, or any referral submission that fails system validations or eligibility checks, shall not be the responsibility of Scaler, and no referral rewards shall be payable in such cases.

The Referrer must refrain from sharing their referral code or referral details with any employee of Scaler or any entity associated with the direct sale of Scaler’s Programs for the purpose of attributing referrals to prospective learners with whom the Referrer has no prior connection. Any violation may result in deactivation of the referral facility and forfeiture of unpaid referral rewards, at Scaler’s discretion.

A Referrer is required to share only their own valid payment details, as prescribed by Scaler, in order to receive referral rewards. Referral rewards shall be payable only if the Referrer has completed their own payment formalities for the Program(s) enrolled in and has not opted for a refund. Scaler shall not be responsible for referral rewards credited to incorrect or invalid bank accounts or contact details shared by the Referrer.

Any queries or claims relating to referral rewards must be raised within 3 months from the date of the Referee’s enrollment. Referral rewards that remain unclaimed for a period of 3 months from the date of eligibility shall lapse and no replacement rewards shall be provided. Rewards shall be deemed unclaimed if processing fails due to incorrect or unavailable bank details, PAN details, or failure to respond to Scaler’s communication requests.

If any referral reward or payment is incorrectly credited to a Referrer, Scaler reserves the right to recover such amounts by adjustment against future payouts or through other lawful means.

5 Use of your Information and User Data

You shall communicate clearly that you, not Scaler, are the sender of all marketing communications related to the promotion of Scaler’s Services

All User Data that you create, transmit, transfer to us, submit, display or otherwise make available while using the Scaler Services, should only be information that you own or have the right to use or share (as may be applicable). If you transfer any personal information to us , we will assume that you have informed the person concerned and procured the necessary consent for such transfer, sharing, processing and/or using the information on the Platform and/or in respect of the Services. We may use the above information as per our Privacy Policy, terms and conditions, and in accordance with applicable laws.

While we make commercially reasonable efforts to ensure that the data stored on our servers is persistent and always available to our Users, we will not be responsible in the event of failure of the third-party servers or any other factors outside our reasonable control, that may cause the User Data to be permanently deleted, irretrievable, or temporarily inaccessible.


6 A 'Qualified Referral' does NOT include the following:

  1. Referrals made to any persons who have performed any activity on Such referrals shall not be deemed as Qualified Referrals and may be blocked at the time of referral submission through system validations.
  2. If a Referee referred by a Referrer initiates cancellation or refund of the subscription/course fee on the Platform within 30 (thirty) days of the start of course instruction, or such other refund/trial period as may be mentioned on the Platform (whichever is applicable), or if there have been any chargebacks raised by such Referee, then such referral shall not be deemed a Qualified Referral, and the Referrer shall not be entitled to any Referral Rewards in respect of such Referee.
  3. No referral shall be considered a Qualified Referral if Scaler suspects any fraudulent, abusive, or manipulative activity by the Referrer to increase referral counts, including without limitation the submission of incorrect, misleading, fictitious, or duplicate information, use of automated systems or software, creation of multiple identities, or any activity that does not comply with these Referral Terms and/or Scaler’s Platform Terms. In such cases, Scaler reserves the right to terminate or suspend the Referrer’s participation in the referral program, at its sole discretion.
  4. Where any Referee has received or has been offered any coupon, refund, credit, cashback, or discount by the Referrer to induce enrollment in a Scaler Program, without prior written authorisation from Scaler, such referral shall not be deemed a Qualified Referral.
  5. If it is found that a Referrer has adopted marketing or promotional practices that are in contravention of these Referral Terms, Platform Terms, or any applicable law, or that are deemed unethical or likely to result in fraudulent or low-quality signups, then referrals generated through such practices shall not be treated as Qualified Referrals.
  6. Any referral that is deemed to be in contravention of these Referral Terms, the Platform Terms, or any other terms or policies communicated by Scaler to the Referrer from time to time (including via email or dashboard notifications), shall not qualify as a Qualified Referral, at Scaler’s sole discretion.
  7. Referral invitation links or referral submissions posted on public platforms or social media, even if containing valid information about Scaler or upskilling, may not be considered eligible for referral benefits. The final determination of eligibility shall rest solely with Scaler, subject to post-submission verification.
  8. The referral submission and referral code usage shall be evaluated on a case-by-case basis by Scaler. Scaler reserves the right to block or invalidate any referral submission or referral code if misuse, abuse, or policy violation is suspected. Scaler’s decision in this regard shall be final and binding.
  9. Any referral made in contravention of the consent and communication requirements set out in paragraph 4 above, including but not limited to unsolicited outreach, cold calling, or contacting individuals without prior communication or consent, shall not be deemed a Qualified Referral.
  10. Any referral made without any prior communication or genuine relationship between the Referrer and the Referee shall not be considered a Qualified Referral. If a Referee is unable to identify the Referrer, or if the Referrer is unable to provide reasonable evidence of prior communication or connection, such referral shall not qualify.
  11. If a Referee does not enroll and complete the required payment formalities for a Scaler Program within 30 days from the referral submission timestamp (referral validity period), such referral shall be treated as unsuccessful and shall not be deemed a Qualified Referral.

7 Marketing and Promotions:

  1. You shall bear all costs and expenses incurred in marketing and promoting Scaler. Scaler will not bear, reimburse, or credit any such marketing expenses
  2. You hereby represent and warrant that your marketing practices do not violate any of the following restrictions. you shall -
    1. not advertise Scaler as a free product.
    2. not make any false, misleading, or disparaging statements with respect to the Scaler, its employees, its customers, its affiliates, its Services, or the Referral Program.
    3. not use traffic that is generated by, including, but not limited to, pay to click, pay to read, banner exchanges, click exchanges, cost-per-view advertising, pop-up/under, spam, purchased traffic, or similar methods without prior written consent from Scaler.
    4. not create websites or advertisements that copy, imitate, or resemble the look and feel of Scaler’s Services.
    5. not engage in the advertisement of business-opportunity websites or use marketing practices that attract fraudulent or short-term customers.
    6. not engage in any marketing activity that may harm the reputation or credibility of Scaler, including but not limited to using low-quality marketing materials, or advertising on any website that promotes violence, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or any illegal activities, or violates the intellectual property or other rights of a third party.
    7. communicate clearly that they, not Scaler, are the sender of all marketing communications related to the promotion of Scaler’s Services as part of the Referral Program.
    8. not market using bulk broadcast/telemarketing/text message/email marketing or any other mass communication method, including posting using the Scaler name or trademark without the express written consent of Scaler, and posting invite links and Referral Codes without the consent of Scaler.
Any breach of the above representations and warranties, will result in the referral not being treated as a Qualified Referral.

8 Fair Usage Policy

  • Scaler’s Referral Policy has been designed with the intention to make education a cost-effective option for the friends/colleagues/connections and family members of our ever-growing student community.
  • The Referral Code usage shall be evaluated on a case-to-case basis by Scaler. If misuse of a referral code is suspected, Scaler has the right to deem the referral null and void. The decision of Scaler will be final in this case.
  • Referral Rewards are non-transferable; non-endorsable; non- exchangeable for equivalent amount of money or anything of value. Scaler does not promise/promote to do the same.
  • To validate fair usage, Scaler may conduct a simple call-based verification process to understand the connection between the referrer and referee.
  • The referral code once entered by the referee and who has enrolled with Scaler, cannot be modified/changed. If the referral code once entered by a referee is incorrect, the policy remains the same and the final decision lies with Scaler. Nothing contained herein will create a relationship of employment or other similar contractual relationship between Scaler and the Referee.
  • If it is found that a Referrer is influencing a Referee to use their referral code, by offering them money/part of their Rewards, this can lead to deactivation of Referral Code.
  • Alumni sharing alum connect leads (i.e. leads referred by Scaler to a Scaler Program alumni), as Referrals will not treated as Qualified Referrals.
  • In the event of any breach of the terms of this Referral Policy (which will include making or attempting to make any Enrolled Referrals that are not Qualified Referrals, except where the Referee opts for a refund within the Trial Period) by a Referrer, Scaler has the right to cancel your Referral Code and ban you from participating in the Referral Policy.

A- The referral link can be found in your learner dashboard on the Scaler Platform under the ‘Refer & Earn’ section.’

How can I refer my connections?

A- You can visit the ‘Refer & Earn’ section on your dashboard and submit your friend’s details (such as email ID, graduation year, program they are interested in) through the referral form available on the page. Referrals must be submitted only through this flow for them to be considered valid.

Can I track my referrals?

A- Yes, you can track your referrals through your dashboard. Any referral successfully submitted by you will appear on the dashboard along with its current status (for example: submitted, enrolled, reward eligible, or unsuccessful).

What benefit will my friend get if I refer them?

A- The Referee may receive a fee waiver on the Program fees, which will be applied at the balance payment stage. The value and applicability of this waiver may vary by cohort and is subject to Scaler’s prevailing policies and approval.

When can I expect to receive my referral rewards?

A- Referral rewards are processed within 45 to 60 days after the Referee successfully completes the Trial Period of the cohort, subject to fulfilment of all eligibility criteria and verification checks by Scaler.

Why have I not received my referral reward?

A- This could be due to one or more of the following reasons:
  • The Referee has not yet completed the Trial Period after the batch commencement.
  • The Referee has not completed the required fee payment for the Program.
  • The Referee initiated cancellation or refund within the applicable Trial Period.
  • Your bank or payout details are missing, incomplete, or incorrect on the dashboard.
  • The referral did not qualify due to system validations, eligibility checks, or unsuccessful referral status as reflected on your referral dashboard.

How are my referral rewards given to me?

Cash rewards are processed via bank transfer to the Referrer’s registered bank account details provided by them on the learner dashboard.
